| 摘 要： | 随着现代文明社会对人权的关注和保护,死刑的存废之争越来越受到人们的关注.文章以刑法价值为指导,以刑法实证主义为重点,反思我国现行的死刑制度的不足,从严格限制死刑的适用范围、适用对象等方面完善死刑立法,从司法适用方面严格死刑复核程序,放宽死缓的适用条件,考虑设立赦免制度,切实贯彻"少杀、慎杀"的死刑政策.

| Abstract: | To preserve or to abolish capital punishment is a focus in criminal law theory.Guided by the value of criminal law and stressed with positivism,this article reflects flaws of our present capital punishment system ,suggests to restrain the domain,subject and legal procedure of capital punishment strickly,add amnesty and then abolish capital punisument on the end. |
