试论重构刑罚的目的——刑罚目的三层次论

本文全面论述了刑罚的目的,对当今传统的刑罚目的即一般预防和特殊预防提出了商榷意见.笔者主张刑罚的目的应该是分层次性的,是有惩罚、矫正和秩序共同一个整体.惩罚是刑罚目的的第一层次,是由刑罚的本质属性决定的;矫正是刑罚目的的第二层次,它来源人权的发展;秩序是刑罚目的的根本目的,这是由于社会的本质决定的.惩罚和矫正是针对犯罪人,通过两者的效果实现秩序的恢复.

The paper comprehensively expounds the purpose of penalty,putting forward different views on the traditional purpose of the penalty,that to is general prevention and special one.The author suggests that the purpose of penalty should have levels.It composes of punishment,correction and order.Punishment is the first for the purpose of penalty,correction is the second for it,and order is the third for it.This is due to the social nature.Punishment and correction point to offenders.The restoration of order finally achieve through them.
