大数据安全法律保障机制研究

“大数据”近年来可谓炙手可热，成为众人瞩目的焦点，蕴含着巨大的价值和无限的开发潜能。在大数据这个无硝烟战场上的落后和失守，会引发个人信息安全问题，甚至还会影响社会发展和国家安全。目前，我国在大数据安全保障方面的政策法规还付之阙如。为迎接大数据时代的机遇和挑战，我国应构建大数据安全法律保障机制。该保障机制由总则、私法机制、刑法机制、行政法机制和国际法机制等五大部分组成，并遵循数据主权原则、数据保护原则、数据自由原则和数据安全原则等基本原则。

Legal Safeguard Mechanism of Big Data Security

Big data is hot in recent years, which becomes the focus of attention. It has tremendous value and great potential for exploitation. The improper management of big data not only can lead to the issue of personal information safety, but also even affect social development and national security. At present, there is still a lack of the policies and regulations of big data security in our country. In order to meet the opportunities and challenges of big data era, our country should build the legal safeguard mechanism of big data security, which is composed of five parts, such as general rules, the private law mechanism, the administrative law mechanism, the criminal law mechanism and the international law mechanism. The legal safeguard mechanism of big data security follows the principle of data sovereignty, data protection, freedom of data, data security and so on.
