| 摘 要： | 在各种简易诉讼程序中“辩诉交易”制度是刑事诉讼中颇具特色的制度。从法律经济学的角度来看“辩诉交易”,它能提高刑事诉讼的效益,但它不能超越诉讼的最高价值——公平正义。
