| 摘 要： | 对物权行为及其独立性和无因性问题的认识，学界意见不一。文章从物权行为的概念、特征等基础理论入手，对物权行为的独立性及无因性进行了再探讨，认为物权行为及其独立性与无因性是纯粹的法技术的构造物，进而提出承认物权行为，而不承认其独立性和无因性的观点，以期对我国的物权立法有所裨益。

| Abstract: | The act of real right and its independent and no-cause characters are issues that remain controversial. This essay approaches those two characters on the basic theoretical level by discussing the concept and the features of real right, concludes that the notion of real right as well as its independent and no-cause characters are shear technical fabrications of the science of law, and then suggests rejecting the view that the act of real right has independent and no-cause characters while recognizing the act of real right itself in legislation in this respect in our country. |
