城市房屋拆迁法律制度的理论分析

摘    要:城市房屋拆迁是一个敏感而又普遍的社会问题,广为社会各界瞩目。本文介绍了我国现行的城市房屋拆迁法律制度,并简要分析拆迁制度的法律特征属性,然后着重剖析具有强制力的城市房屋拆迁的理论依据,即社会公共利益,这也是从法律上判断一项具体的拆迁行为是否合法的唯一标准。为规范拆迁,保证政府拆迁主管部门在拆迁活动中正确履行相关职责,应当借鉴有关国家在城市改建中的公共开发制度和广州市的城市房屋拆迁模式,以期建立一套更科学、公正、有效的房屋拆迁法律制度。

Research on Legal System of the Demolition and Relocation of Urban Housing
Abstract:The demolition and relocation of urban housing is a universal and sensitive social problem for which. this essay is to analyse China's legal system. After a brief introduction of the current system, this essay sums up its legal features, and then emphasizes the enforceable theoretical basis for demolition and relocation of urban housing, that is,social public interests, which serves as the legal critirion to decide whether a specific practice is legitimate or not. To regulate building demolition and relocation practice, and to ensure that government agencies are responsible for this practice This essay introduces from other countries the public exploitation system in city reconstruction work, and concentrates on Guangzhou mode for building demolition and relocation, with the aim to form a scientific, fair and effective legal system for building demolition and relocation project in cities.
