村民自治制度的宪法完善与法律创新

村民自治属于社会自治的范畴，因而不是国家活动。据此，建议《宪法》在“总纲”中明确社会自治的地位，在“公民基本权利”中赋予公民自治权，并删除《宪法》第111条关于基层群众自治组织的规定，从而合理界定村民自治的宪法地位。以《宪法》为依据，以村民自治权为逻辑起点，制定《村民自治法》，建立多元的自治模式，从而建立完备的村民自治法律体系。

Constitutional Perfection and Legal Innovation for Villagers Autonomy System

The villagers autonomy falls into social autonomy,is not national activities.It is suggested that the Constitution shall stipulate the social autonomy in its General Principles,and grant citizen autonomy in "Fundamental Rights of Citizens",and delete the provisions of self-management organizations at grass-roots levels in Article 111,and thus reasonably define the villagers’ autonomy as the Constitutional rights.In accordance with the Constitution,based on the right of villagers’ autonomy,The Code of Villagers’ Autonomy shall be formulated,which can establish a multiple autonomy modes,and establish a complete legal system for villagers’ autonomy.
