| 摘 要： | 中国环境立法在艰难的境遇中取得了一定成就,更面临巨大的困难.环境法律缺乏实效、守法自觉尚未形成,以及部门造法与权力交涉的工作局面,"宜粗不宜细"的立法原则、法律移植"水土不服",难以提供法律救济的救济手段、公众监督的效力不足等都是立法者必须正视的现实问题.

| Abstract: | China has made some achievements in environmental legislation,but also faces enormous difficulties.The actual effects of positive environmental law,law-abiding awareness,interest-based legislative negotiation,the legislative principle of preferring to be broad rather than detailed,the acclimatization of legal transplantation,the reasonableness of legal remedies,and public involvements are key practical factors determining the quality of China's environmental legislation. |
