我国建立金融控股公司加重责任制度探讨

金融控股公司已经成为我国金融业混业经营试验的基本路径并在过去的几年中获得了飞速发展,制定金融控股公司法已是大势所趋.关于金融控股公司加重责任制度的构建,应遵循确定性原则、灵活性原则、最低成本原则和公平公正原则,主张在"三会联席会议"的基础上,组建金融监管协调委员会作为金融控股公司的监管主体,以确定规则式为该委员会的主要监管方式.并且,未来的金融控股公司法应对加重责任制度的适用场合、适用程度以及对行政相对人的救济措施等问题作出明确规定.
