行政相对人的权利系统重塑

行政相对人权利系统的传统构造,要么不能做到从行政法的个性角度保持内容上的完整性,要么缺乏动态联系并使逻辑关系显得不够严密。因此,应该重塑行政相对人的权利系统,将行政相对人的权利划分为自主性权利、请求性权利、沟通性权利、参与性权利、救济性权利,并在此基础上进行详细的展开。

Rebuilding the Right System of Private Party

The traditional right system of private party has its defects, i.e. it fails to maintain its completeness in contents considered from the perspective of specific characters of administrative law, and it lacks the dynamic connection, which results in the weak logical relationship between rights. It is imperative that the right system of private party be rebuilt by classifying it more delicately into decision-making rights; appealing rights; communication rights; participation rights, rights to be remedied, etc. Based on these rights, more detailed presentation is conducted.
