“无限防卫”之探析

“无限防卫”的规定是刑法价值的体现 ,中外刑法对此多有规定。在借鉴外国立法例的基础上 ,我国 1 997年刑法规定了“无限防卫”制度 ,其优点在于保护公民合法权益和规范法官判案 ,其缺陷主要在于立法语言的不准确 ,容易引起歧义。若时机成熟再次修改刑法时 ,可以采取明确列举进行表述的方式给予完善

The legislation of the Unlimited Defense embodies the Value of the criminal Law,as is concerned in the Laws of different states.On the basis of reference of legislation in other countries,China,in 1997,established the Unlimited Defense with the advantages of protecting citizens' lawful rights and interests and standardizing trails and disadvantages of its indefinable languages of the legislation.If the time comes when the criminal Law will be modifies later,the Law should be perfectly amended by adoption of clear and definite expression of enumeration.
