| 摘 要： | 《婚姻法》第四十二条规定的离婚经济帮助制度,为当事人离婚自由的实现提供了保障,保护了当事人的合法民事权益,尤其体现了《婚姻法》对离婚中经济弱势一方主要是妇女的保护。但是,我国离婚经济帮助制度仍存在诸多缺陷,应当将相对困难标准和义务人具备负担能力作为离婚经济帮助的适用条件,明确规定离婚经济帮助的考量因素、方式、变更和终止的情形,因离婚方式的不同合理设置离婚经济帮助请求权的行使时间。

| Abstract: | The system of divorce economic assistance has been provided by Article 42 of the "Marriage Law".The system guarantees the freedom of divorce of party and protects the legal civil rights and interests of party.In particular,it reflects the protection of economically disadvantaged party in divorce,usually the female,by the "Marriage Law".However,there are many defects.The applicable conditions of divorce economic assistance should include the relative economic difficulty standard and the financial ability of obligor.The considerations,method,situations of change and termination should be clearly defined.And the exercise time of divorce economic assistance claim should be reasonably set up according to the different method of divorce. |
