《矿产资源法》修改中几个基本问题的研究

自1996年《矿产资源法》修改以来,国际和国内环境发生了巨大变化,特别是我国于2001年成为WTO成员以及2003年伊拉克战争的影响,使得进一步修改《矿产资源法》更为必要而迫切。本文分析和探讨了修改《矿产资源法》过程中应当注意而目前研究尚不深入的六个基本问题,即修改《矿产资源法》的指导思想、国家对矿产资源的主权权利、矿产资源的配置和对权利或者利益的考量、市场在矿产资源配置中的作用、矿产资源的勘探开发中一些重要问题、矿产资源产品的物权。

Research on Several Fundamental Issues in Amending The Mineral Resources Law of PRC

Since the amendment of The Mineral Resources Law of PRC in 1996,both the international and domestic contexts have been greatly changed.In particular,China's membership of WTO obtained in 2001 and the influence of 2003 Iraq War make it necessary and urgent to amend the law.This paper analyses and discusses six fundamental issues that should be stressed in the process of amending the law: the guiding thoughts for amending the law,the state sovereignty over mineral resources within its jurisdiction,the rights and benefits that should be taken into consideration,the role of market in the allocation of mineral resources,the vital problems in exploiting mineral resources,and the property rights of the products of mineral resources.
