| 摘 要： | 法学与哲学之间存在着天然的亲缘关系。近现代宪法与宪政所赖以建构的哲学基础是以个人为本的自然法思想。自然法思想中所蕴含的个人主义、个人的权利和自由,以及由此引申开来的个人的志向、价值、福祉、安全等价值观念,构成了近现代宪法和宪政所建立和发展的最高原则和终极目的。
