| 摘 要： | 什么样的法律才是正当的法律,社会应当制定怎样的法律?无论在理论还是实践的域界,这都是一个十分重要而无法回避的问题。从伦理学上的"正当"观念入手,分析法的正当性评价与选择方式的一般构成,并在此基础上构建一个包含着"法的制定方式"、"需要的种类"、"评价与选择的主体"等要素的分析模型,就能揭示由于主体、客体、需要等诸方面的差异性而形成的冲突状态。"局外人仲裁程序",为法律及其存在方式的正当性评价和选择提供了程序标准。

| Abstract: | What is the justice law, and which kind of law should we create? Starting with the concept of justice in ethics , the author has analyzed the general means of the evaluation and selection of law based on justice .Here from we establish a model for analysis including 'the method of creating the law', the classes of demand' and 'subjects of evaluation and selection' ,and reveal the conflicting state according to the variances on subject ,object and demand. In order to eliminate the collision and find a procedure standard for reference , this paper advocates a project named 'arbitration procedure from outsider'. |
