| 摘 要： | 本文针对目前有较多争议的《合同法》第286条规定的建设工程承包人优先受偿权的定性问题,通过比较不同观 点,进而澄清优先受偿权的概念及其性质。以便能切实解决承包人优先受偿权与一般抵押权,承包人优先受偿权与承 购人对预售商品房的请求权发生竞合时,如何确定其优先受偿次序以及当前建设单位大量拖欠工程款的问题。

| Abstract: | The passage aims to clarify the concept and charactersistics of priorities by comparing different views since there exists many disputes on priorities of contractors in building project in the 286th clause of Law of Contract so as to solve such problems as prior compensation right and general mortgage right when the priority of contractors is not consistent with buyers'request right for commercial residential buildings, we can confirm its order and solve the problem that construction organization default engineering funds greatly. |
