休息权初探

休息是指人们具有某种直接目的的工作和学习等活动的停止状态或人们恢复体力与脑力的行为。作为一种法定权利．休息权是居民和劳动者享有的使自己的体力和脑力得到恢复，以及得到闲暇以享受生活和获得充实与发展且不受非法干涉和骚扰的权利。休息权的内容包括休整权、休假权、休闲权和安宁权四个基本方面。作为一项基本人权，它具有人类生存和发展的理念；作为劳动权的有机组成部分和必要补充，它是劳动力再生产的基本前提和经济与社会发展的重要源泉；作为自然人的一项重要人格权，它是树立人本观念和建立和谐社会的重要基础。休息权应当得到宪法、劳动法、民法和刑法多种法律制度的保障。
