中国传统行政组织文化与公共权力制约困境

摘    要:中国传统行政组织文化极强的穿透性与历史延续性的影响对现今公共权力制约造成一定的困境。本文阐述了中国传统行政组织文化对公权力制约困境的表现形式;基于行政人格二重性和中国传统行政组织文化的正负价值,分析中国传统行政组织文化对公权力制约困境产生的原因;并针对困境原因提出相应的对策。

Abstract:With strong penetrability and historical continuity,Chinese traditional administrative organization culture causes a certain dilemma on public power restriction.This paper expounds the representation on public power restriction dilemma of Chinese traditional administrative organization culture,combines positive and negative factors of Chinese traditional administrative organization culture with government administrative personality duality,to analyse reasons that emerge from Chinese traditional administrative organization culture on public power restrict,and puts forward corresponding countermeasures to the reasons of dilemma.
