| 摘 要： | 患者的知情权和同意权是两个独立的权利,在我国现有的法律体系中,权利的保障缺乏上位法的支撑,目前在操作层面起主要作用的大多是一些行政法规或者部门规章.立法层面从某种程度上似乎忽视了医方所应履行的治病救人、救死扶伤的道德义务.法律法规的主要内容将患者知情权与患者同意权揉杂在一起,模糊了两者的差异和不同之处.促进医疗机构履行告知和说明义务的规范化有利于患者知情权的实现.
