我国合同法对于隐名代理制度的吸收适应了市场经济发展的需要 ,突破了长期以来我国民法代理制度中仅限于显名代理的规定 ,使得我国民法中的代理制度更加完整、全面。文章通过对大陆法系中的显名代理、英美法系中的隐名代理及隐名代理在现代商品经济生活中对传统显名代理的冲击的论述 ,明确了我国合同法确认隐名代理的现实意义及必要性
