| 摘 要： | 近年来法学理论界在发掘法律文化传统资源的思考中较为关注儒家文化对构建现代和谐社会的启示;笔者认为儒法合流乃是形成中国法律文化特征的思想基础,其中法家思想所独有的某些观点对现代法治同样具有一定的启示和参考意义。

| Abstract: | When the accademic circles of law theories are digging up the traditional law culture resources in recent years, they pay concerns to the apocalypse of Confucian culture to the constuction of modern harmonious society. The author believes that the confluence of Confucianism with the Legalist thoughts is the thought basis of Chinese law culture, among which some peculiar Legalist thoughts have certain significance of apocalypse and reference even for modern rule of law. |
