| 摘 要： | 知识产权与物权有着财产权的相同属性,法律对物的确权,即表现为物权;法律对知识产品的确权,即表现为知识产权。相对而言,物权对知识产权影响深远,乃知识产权的母性权利,但知识产权的原则也对物权有积极意义,权利穷竭原则在解决两种权利的冲突中扮演着重要作用。

| Abstract: | In the legal nature,intellectual property and the property has the same property.The law makes sure the right to thing,that the performance of the property,make sure the right of knowledge products,that the performance of intellectual property rights.In contrast,there is a far-reaching impact of intellectual property rights,and is the intellectual property rights of motherhood,but the principles of intellectual property rights has a positive meaning to the property,the principle of exhaustion of rights in the settlement of the conflict in the two rights play an important role. |
