| 摘 要： | 针对表演权与表演者权权利的主体，在客观上存在诸多的联系，在权利行使上确有所明显差异问题，通过静态和动态上的对比分析，提出当表演权人和表演权不相互独立、交叉，甚至重叠、冲突的时候，本文要对两种权利进行平衡，既充分保护表演权人和表演者权人的利益，又方便作品和表演本身的价值实现。

| Abstract: | There are a lot of connections between the performance rights and the subject of the performer's rights.But their exercise of rights shows remarkable difference.Through contrast analysis statically and dynamically,the thesis explores how to balance between the person of performance rights and the performance rights when they are not independent of each other,overlapping and even clashing,in order not only to fully protect the benefits of both the person of performance rights and the person of the performer's rights,but also to facilitate the value realization of the works and the performance. |
