| 摘 要： | 历史性权利是历史性水域的理论依据,《联合国海洋法公约》对历史性权利的地位并没有明确规定,但从条约解释规则及时际法理论分析,《联合国海洋法公约》并没有否认历史性权利的存在。唯有通过利益相关国的不断努力才能使《联合国海洋法公约》明确规定历史性权利在公约中的地位。

| Abstract: | Historic right is the basis of historic waters.Though the United Nations Convention on the Law of the Sea(UNCLOS) does not specify the status of historic right,the UNCLOS does not deny the existence of historic right from the point of general rule of interpretation on treaty and theory of intertemporal law.Only by striving of interested states,can the status of historic right be specified by UNCLOS. |
