近代日本多版本《万国公法》考察

西方列强以"万国公法"为理论工具打开日本锁国大门后,日本的思想家、政治家们便采取了多种手段引进西方的法律制度。其中,多版本的《万国公法》在近代之初的日本纷纷登场,成为日本近代法体系的有机构成。与此同时,其自身伴随着近代日本社会的发展变化而变化,并表现出不同的阶段性特征。这些特征所表现出的实质意义在于:为日本社会不同时段的需求提供了理论武器。考察近代日本多版本《万国公法》,可以发现日本走上战争道路的法理原因。

Investigation of Multi-version"Elements of International Law"in Modern Japan
