论我国环境法治中的环境正义

环境正义是较新型的环境价值观，由于经济、社会、历史等原因，我国环境立法中环境正义理念缺失，导致环境权益和责任分配不公，最终降低了法律的效率。事实上，环境问题不只是人与自然的失调，更是人与人关系失调的结果，因而要在我国环境立法中确立环境正义理念，明确环境正义原则，并在此基础上建立和完善相关具体法律制度。

Environmental Justice in China's Environmental Law System

Environmental Justice is a new type of environmental value. However, due to economic, social and historical reasons, the principle of environmental justice is absent in China＇ s environmental law system, which results in the unfair distribution of environmental interests and obligations, and has thus reduced the efficiency of environmental law in China. In fact, environmental crises result more from the imbalance of human rations than the imbalance between man and nature. Therefore the principle of environmental justice must be established in China＇ s environmental law, and the related rules and regulations must be improved accordingly.
