论儿童上网权的法律保护

随着互联网技术的发展,儿童上网越发容易和低龄化。依据国际公约、我国宪法和法律的相关规定,儿童上网可视为一种法律权利,其实质是儿童作为人的利益和生存发展的利益。为了保障儿童这一利益,应建立起完善体系解决上网权保护与父母言论自由冲突、与学校教育教学管理权冲突、与父母监护权冲突、与知情权冲突等。这就要努力使国家、学校、家庭和社会的权利与责任达到平衡。

With the development of Internet technology, it becomes easier and lower in age for children to access Internet. According to the relevant provisions of the international conventions, and the Chinese Constitution and laws, the accessing of Internet of children can be regarded as a kind of legal right, whose essence is the interests of children as human beings and their survival and development. In order to protect this interest of children, a perfect system should be established to resolve the conflicts between the protection of right of accessing Internet and the speech freedom of parents, or the educational and teaching management power of school, or the parental custody right, or the right to know, etc. It requires the efforts to balance the rights and responsibilities of the state, schools, families and society.
