高校毕业生就业协议的法律性质分析

An Analysis of the Legal Nature of Employments Agreements Signed by Collage Graduates

The system of employment agreements that the State enforces on college graduates exercises a deep-going influence on them.Employment agreements mainly refer to the agreements signed between collage graduates and the subjects of employing units in conformity with the stipulations of the labor law.There have been different opinions about their legal nature in the academic circles.We believe that employment agreements are just labor contracts in terms of their legal nature.These agreements tally with the features of labor contracts.Their main contents accord with the contents of the latter.Therefore,they are a special type of labor contract.There are also some issues deserving deep-going explorations,including the related college's status in the agreement,the employee's service term and the fine for violating the agreement.
