外层空间活动许可制度研究

随着外层空间商业化与外层空间私营化的不断发展,越来越多的私营企业(非政府实体)将涉足外层空间商业领域。由于目前的《外空条约》所调整的对象是国家和国际组织等国际法主体,私营企业的外层空间活动被视为相关国家的行为,由该国家承担由此产生的法律后果。为此,各国为监督管理本国管辖范围内的私营企业从事的外层空间活动,在适用有关国际公约内容的基础上,相继制定了本国的外层空间法律制度,其中外层空间许可制度基本上构成了各国外层空间立法的核心内容。

As the development of the outer space commercialism,more and more private enterprises(or non-government entities) will participate in the fields of space commercial activity.At present,the treaties in outer space only govern the activities of nations and international organizations,so the activities of the private enterprises have being looked as relative government activity,And the legal consequences of these activities will be taken by the relative governments.In order to regulate the acts of private enterprises and non-government entities,many nations have set up laws or regulations in outer space to regulate activity in outer space,the license institution is the one of key elements of their outer space legal system.
