论法治的文化基础

任何制度都是特定精神和文化的载体。近代以来,中国社会未能走上法治之路,不仅仅是政治认同问题,关键在于法治文化基础的缺失。面对中国在法治现代化进程中所出现的种种问题,通过政府推动的方式加强道德建设,转而致力于社会文化底蕴的塑造,以及更深层的社会心理、观念的变革,是一条中国特色的法治现代化道路。

Every system is arefiection of certain spirit and culture. Since the beginning of the last century, China has not been implementing rule of law, which is not only a matter Of political agreement, but also lack of the culture base of the rule of law. Confronted with kinds of problems arising from the process of China's modernization of rule of law, a way of law modernization with Chinese characteristics will be strengthening moral construction through government propulsion and working at establishment of social culture as well as innovation of social mentality and conception.
