论市场经济条件下农民发展权的法律保护

对市场经济条件下农民发展权的法律保护问题进行了研究，指出发展权是一项人权，从其本质上来讲，主要是弱势群体的发展权利。我国农民作为一种弱势群体，在当前的市场经济条件下，由于各种原因，未能享有与其他市场主体平等的发展权。认为只有形式平等是不能解决农民发展问题的，特别是在现有法律还不足以保护农民发展权的条件下，必须从实质平等上加以解决，因此，还需制定新的法律来保护。

Legal Protection for Peasants' Development Rights Under Market Economy

The right of development is one of the human fights, which is particularly important for weak groups. In China, peasants as a weak group cannot have the same equal opportunities to develop themselves as other economic parties under current market economy situation due to various reasons, one of which is that the law currently in effect is not enough to protect their rights. Therefore, it is necessary to establish new laws to protect them with essential rather than formal equality of opportunity for development.
