死刑存废刍议

文章从法理上,参与限制、废除死刑的讨论。认为死刑是一种非理性的刑罚,有很多弊端,如非人道性,不可更改性。我国在本世纪将迈入小康社会,进入中等发达国家行列,并赶超最发达国家。生产力的发展必然导致法律这一上层建筑的变革,随着政治、经济、文化的发展,人类社会的进步,死刑制度终将被放弃。

Discussion on the existence and ablition of death penalty

This paper argues that death penalty should be restricted and abolished in legal principle. Death sentence is considered as an unreasonable penalty with many disadvantages,such as non humanity,unalterable feature. China will enter well-do-level society stepping into mid-developed line and keep up the developed countries in this century. The development of productive force can lead to the reform of law. With development of politics, economy, culture and the progress of human society, death penalty will be abandoned finally.
