跨界环境损害国家责任

探讨国家责任必须首先厘清国家责任与国际责任的关系。跨界环境损害国家责任是指可归因于国家的行为造成跨越国界的环境损害的责任。从主、客观方面分析，国际法未加禁止的行为造成跨界损害后果的，该行为既可归因于行为所属国，又因造成跨界环境损害后果而违反国际习惯法，具有违法性。所以，国际法未加禁止的行为造成跨界环境损害后果的，应承担国家责任。

State Liability for Transboundary Environmental Damage

A thorough discussion of state liability should be based on a clear idea about the relationship between national liability and international liability for transboundary environmental damage. Damage arising out of national activities results in state liability. If, analyzed subjectively and objectively,the damage is due to an activity which is not prohibited by international law, the activity should be considered to have been carried out by the source state. The legal wrongfulness of the activity can be established for the violation of traditional international law in giving rise to transboundary environmental damage. Therefore, state liability results from transboundary environmental damage arising out of an activity which is not orohibited by international law.
