论物权行为无因性的两层含义

物权行为的无因性有内在无因性与外在无因性两层含义。内在无因性是物权行为作为一种独立的法律行为之核心要素意思表示的内容本身所具备的内在属性 ,是物权行为的生命属性 ;而外在无因性则重在从法律技术上区分物权行为与债权行为间不同的效力关系 ,重在从形式上对物权行为与债权行为的全部构成要素以区分原则为前提进行全面比较 ,因此要做到这一点 ,就必须以意思表示来正确理解法律行为 ,必须以正确理解内在无因性为基础。我国对无因性的认识只是外在无因性之含义 ,而缺乏内在无因性含义的分析。
