司法保障人权机制推进路径探析

On the Ways to Improve the Judicial Guarantee of Human Rights in China

Regulating human rights in the constitution raises an urgent requirement to innovate present human rights protection mechanism.In order to fulfill the principle of "state respects and safeguards human rights",judicial officers should promote the jurisdiction of human rights clause in constitutional law,strengthen the guarantee of citizen's fundamental right,and change the situation of human rights protection in the field of criminal justice.In overall judicial process,every citizen should be entitled to the right of access to justice,the right of impartial jurisdiction and the right of due process.
