商品房包销方式的司法解释

商品房包销作为一种新类型促销方式在我国大陆房地产市场上运用,一方面促进了房地产市场的繁荣和发展,但同时也带来了许多问题,产生了不少纠纷.目前我国法律、行政法规对商品房包销没有做出明确的规定,只有一个最高人民法院《关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》在司法解释层面上对此作了规定.因此对商品房包销行为的研究具有现实的意义.

On the Judicial Interpretation of Commercial Property Underwriting Practice

The application of a new type of commercial property underwriting on the real estate market in China Mainland,on one hand,promotes the prosperity and development of the real estate market;on the other hand,causes a lot of problems and dissentions.Yet,until now there have been no specific requirements for real estate underwriting in China's present laws or any administrative regulations except for " Interpretation of issues on Laws Applicable to the Trial of Cases concerning Disputes Arising from Purchasing and Selling Commercial Properties" by the Supreme People's Court that only sets some regulations to the effect of judicial explanatory level.And in this sense,the study of commercial property underwriting is necessary and of great significance.
