论高新技术产业中的不正当人才竞争及其法律规制

摘    要:人才是高新技术企业发展的基础和根本 ,但是不正当的人才竞争只会阻碍高新技术企业的发展。高新技术企业中人才不正当竞争的形式包括 :通过订立不平等的合同 ,限制人才的流动 ,否则就要交纳数额高昂的违约金 ;集体跳槽 ;通过订立竞业禁止合同 ,限制人才竞争 ;商业间谍等。文章还分析了不正当人才竞争与侵害企业商业秘密的关系 ,然后根据我国现有的法律规范对如何规制高新技术企业间的不正当人才竞争提出了作者的见解

Abstract:Talents are the basis for the development of a high_and_new_tech enterprise, and unfair competition for talents can only hinder the development of the enterprises. The unfair competition among the high_and_new_tech enterprises includes: restricting the flow of talents by means of unfair contracts; collective job_hopping, restricting competition by contracts prohibiting business strife; commercial spies, etc. This essay also makes an analysis of the relationship between unfair competition for talent and the infringement upon the business secrets of the high_and_new_tech enterprises, and then a probe into the regulation of the unfair competition according to the existing statutory provisions of our country.
