期刊上网与著作权保护

期刊上网有助于信息的传播和利用 ,但也带来著作权保护的一系列新问题。如作品更易于被复制、盗版 ,内容易被修改 ,完整性被破坏 ,著作权人权益不对称等。这是网络出版的特点所造成的 ,一时还难以根本解决 ,但可采取适当的措施加以防范。期刊上网是二次出版 ,应取得作者的授权 ,并采取适当的数字化方法 ,避免上网对内容的改变和破坏。新修订的著作权法规定了“信息网络传播权”为著作权人的权利之一 ,为网上著作权的保护提供了依据。随着信息网络传播权保护办法的进一步制订 ,期刊上网著作权保护问题有望得到较好解决。

On-line publication of periodicals and protection of copyright

On line publication of periodicals facilitates the spread and utilization of information, but it also brings a serious of new problems to the protection of copyright, for instance unlawful copy, modification, and imbalanced rights and interests. Although it is difficult to eradicate these problems under current conditions, some measures are helpful to minimize them. On line publication belongs to a new edition, so author's authorization is equally necessary as printing publication. Appropriate digitalization way should be adopt to avoid damage to the space of a whole page because of different styles of periodicals. The newly edited Copyright Law assigns on line publication as one of the author's rights. It is effective weapon for the protection of on line copyrights. With the constitution of statute for the protection of on line publication, the on line copyrights may be preferably protected.
