作为一种世界性命题,生态安全已确定为我国环境保护的战略目标,其特别关注的是国内生态环境状况的改善,强调防止国内生态赤字、防治自然灾害的国家职能,在规范类型上侧重于国内政策与国内法范畴;生态安全观的确立,对我国环境资源法制建设颇具实践意义与理论价值,生态安全应纳入我国环境资源法的调整范围;我国生态安全法制的建立与完善,既要立足于本国国情,又要借鉴国外经验并应对可能的挑战,其体系基本构成包括国家生态安全法与国际环境安全法。

An Analysis on Ecological Safety and the Law System of China

As a global topic, ecological safety has been set down as a strategic target of environment protection in our country. The most interested points in this topic are the betterment of the ecological environment, the prevention of ecological deficit, the national function on the prevention and treatment of natural disasters. Establishment of the notion of ecological safety is of great practical meaning and theoretical value to our country's construction of law and regulation on environment and resources. Ecological safety should be listed into the adjustment domain of our country's Environment and Resources Law. The construction of law and regulation on our country's ecological safety should be based on our country's domestic situation and should also learn from the experience of foreign countries in order to be able to deal with possible challenges. The basic constructional system of ecological environment safety includes the Law of National Ecological Safety and the Law of International Environment Safety.
