电子商务安全的立法问题初探——兼论WTO与电子商务安全

交易安全问题是电子商务发展的首要和基本问题。法律保障电子商务安全比技术安全保护措施更具根本和终局意义。电子商务安全的法理基础在于防范市场交易风险、贯彻商法交易安全原则、满足人性的安全需要。电子商务安全的法律制度包括网络和信息安全、数据电文、电子签名、电子认证和电子支持等安全制度，对此，应采取适宜的立法模式和切实的实体和程序立法保障对策。

A Preliminary Study of Legislative Issues on E-business Security

The transaction security is the first and foundation issue of developing e -- business. Law protectionof e -- business has greater significance than technological security measure. The basic law theory on e -- businesslies in taking precautions against the risks of marketing transaction, following the security regulation on businesslaw and meeting the needs of the security of human nature. The law system on e -- business security includes thesecurity system of internet and information, data messages, electronic signature, electronic recognition and pay-ment. Therefore, we should take the measures of legislation, entity and procedure to protect e -- business.
