| 摘 要： | 我国刑法对单位犯罪的规制呈逐渐强化和扩张的态势.对单位犯罪的立法宗旨、单位犯罪主体的范围进行探讨,主张单位分支机构和内部职能部门、一人公司及私营企业在一定条件下可以成为单位犯罪的主体.

| Abstract: | China's Criminal Law on the regulation of unit crime shows a trend of enhancement and expansion.This paper discusses the legislative purpose of unit crime and subject scope of unit crime,and holds that branches of the units,internal functional departments,one-man company and private enterprises can become the subject of unit crime under certain condition. |
