论宪政的基本精神及其现实意义

宪政的本质即是限政,也就是限制政府的权力,保障个人的权利和自由。宪政的理论基础是自由主义,自由主义从个人的权利和自由出发,催生了宪政,并且决定了宪政的价值取向。因此,宪政的核心价值是保障个人自由的实现。它为主权设计一套分权制衡的架构,为人权提供制度性保障和司法救济。宪政的价值有着其现实意义。在中国要实现向市场经济的转轨,就应该把宪政作为社会经济的坚实基础。

The nature of constitutional government is to limit government,to ensure individual's rights and freedom.The theoreticol foundation of constitutional government is liberalism.Liberalism proceedes from individual's rights and freedom,and decides the value orientation of constitutional government.So the main value of the constitutional government is to ensure the realization of individual's freedom.It designs a frame of separation of powers for sovereignty and also provides institutional guarantee and judicature relief for human rights.The value of constitutional government has its practical significance.In China if we want to realize economic market system we should make constitutional government as the foundation of society.
