论土地承包经营权“改名”

该文从理论与实践、历史与现实相结合的视角 ,考察了“土地承包经营权”、“永佃权”、“农地使用权”、“农地用益权”、“农村土地承包经营权”等名称各自的长短优劣 ,指出它们都不适合作为物权法中“土地承包经营权”的新名称 ;并认为物权法应采用“农地承包权”的名称 ,其理由是这一名称既体现了对权利的一体保护 ,又和现行法律体系相衔接 ,还准确、精炼地概括了这一权利的内涵

On the Name Correction of Land Contractual Operation Right

The thesis analyses the advantages and disadvantages about the names of “land contractual operation”,“the right of permanence tenancy”, “the right of using agricultural land”, “land contractual operation in the countryside”from the angle of theory and practice, history and reality; and points out all these names are not suitable for using as the new name of “land contractual operation”. This thesis argues that property law should use the name of “agricultural land contractual operation right”, because this name not only embodies the equal protection of rights, but also harmonizing with current legal system and summarizing the content of this right precisely and briefly.
