| 摘 要： | 司法诉讼活动总体上可分为两大阶段:从司法机关立案到法院认证结束为第一阶段,可谓诉讼证明阶段;从诉讼证明结束到宣判为第二阶段,可谓文书证明阶段。前者是思维与实践的有机统一过程,后者则是一种静态的逻辑论证过程。二者在诉讼证明活动中各有功用,前者是后者的基础,后者则是前者的完整表现形式。

| Abstract: | Lawsuit can be divided into two stages. The first stage is the lawsuit proof stage which begins with the placing of a case on file for investigation and prosecution and ends with the attestation. The second stage is the document proof stage which includes the end of lawsuit proof and the pronouncing judgement. The former is the organic unification of thinking and practice. The latter is the static process of logical proof. Both have their respective fanctions in lawsuit proof, with the former as the basis for the latter, and the latter as the full manifestation of the former. |
