| 摘 要： | 人本主义对中国古代司法制度的影响主要表现在：（一）案件的审理审判上,为防止法官独断造成冤假错案,很早形了对大案、要案征求多人意见、逐级审理的审慎的审判制度;（二）为防止上下级法官沆瀣一气、相互勾结、徇私舞弊,很早形成了皇权控制下的检察监督制度;（三）为防止和减少冤假错案、缓和社会矛盾,自汉代形成了皇帝或上级长官直接详审罪囚、平反冤狱的录囚制度;（四）为确保司法公正、消除司法腐败,很早形成了带有明显人本主义色彩的法官回避和责任制度。

| Abstract: | The effects humanism has on Chinese ancient legal system are：firstly,on cases＇ trial and judgement, in order to avoid unjust, false and wrong cases, many persons＇ opinions were asked for the major and serious criminal cases to form the rank by rank prudent censorship.Secondly, to avoid jnges＇of ranks collusion and malpractice＇ procuratorial and supervision system under the imperial authority＇ control was formed. Thirdly, to avoid and reduce unjust,false and wrong cases,and relax social contradictions,the system of interrogating prisoners was established early in Han Dynasty by which the emperor himself or superior official interrogated prisoners for vindication. Fourthly, to ensure legal justice and eliminate corruption of judicature, judges＇ excusing and liability system with humanistic hint was established. |
