| 摘 要： | 笔者在《受贿罪中“为他人谋取利益”要件取消论》一文中曾提出受贿罪客体是国家工作人员的廉洁性及公众对廉洁性的信赖的观点，据此得出，“为他人谋取利益”作为受贿罪必备要件的取消是受贿罪客体的必然要求。取消这一要件将会增强法条的可操作性、明确受贿罪既遂与未遂的区分标准，而且不会产生有些学者所顾虑的与馈赠、诈骗行为无法区分的消极影响。
