| 摘 要： | 现阶段的中国在科学发展观与构建和谐社会的政治思想引领之下，强调实行并进一步完善宽严相济刑事政策。这一基本刑事政策作为惩办与宽大相结合基本刑事政策的延续与调整，将科学地纠正“严打”政策，有效地应对各种形态复杂的犯罪现象，坚持和谐的司法理念，遵循罪刑法定、罪责刑相适应原则，从根本上提高和完善社会主体的道德素质，人文关怀、维护人权自由平等、保障人道主义精神。
