The Application of the Principle of Proportionality in Information Classification

The principle of proportionality is one of the most important means on restricting administrative discretionary power abusing and protecting civil rights.In the process of classifying state secret information,the subjects judge and make discretions according the law and state secret coverage which makes the discretion space to form.Based on this,the application of the principle of proportionality can regulate the exercise of information classification power effectively and coordinate the balance between national interest and personal interest.The paper first describes the significance of applying the principle of proportionality in information classification,and then makes focus on analyzing the three sub-principles and their limitation of information classification in specific application,and gives some recommendation in the end.
