| 摘 要： | 依照我国立法法规定的立法科学原则，通过对高等教育基本规律、基本职能的分析，认为高等教育法是对高等教育基本规律的反映；高等教育的基本职能决定高等教育的立法目的；高等教育法的调整对象是高等教育及其管理关系；科学合理地为大学、学生、配置权利与义务，为政府配置权力与责任是完善高等教育法的路径。

| Abstract: | According to the principle of scientific legislation in our country and based on the analysis of the basic rule and function of higher education, it＇s concluded that the basic function decides the legislation law, the adjusted members of it are the higher education and its management relationship and education law is to scientifically and reasonably deploy rights and obligation to universities and objective of higher education one way to perfect the higher students and power and duty to the government. |
