| 摘 要： | 无论是从世界各国的立法规定来看,还是从理论自身完善的需要来看,无权处分合同应为有效合同,其有效性并不取决于权利人的追认或出卖人事后取得处分权。承认无权处分合同有效对于维护交易秩序、保护第三人利益具有积极意义,也是现代市场经济发展的需要,是世界各国立法的大趋势。
